Copyright issues for Bengaluru's technology and creative companies
Bengaluru's SaaS companies, game studios, design agencies and creator businesses build valuable copyright in code, interfaces, artwork and content. Disputes and diligence findings usually come from unclear ownership, open-source licence gaps or content reused without a licence.
- Ownership of code, UI designs, game art and content by employees, contractors and agencies.
- Open-source licence review before distribution, acquisition or funding.
- Software licences, SaaS terms, content licences and reseller agreements.
- Registration of computer programs and artistic works.
- Takedowns on app stores and platforms, legal notices and infringement claims.
Open-source licences and investor diligence
Open-source components are licensed, not ownerless. Permissive licences such as MIT and Apache 2.0 generally require attribution and licence notices; copyleft licences such as the GPL can require source code to be shared when software is distributed. How the product is delivered, whether as SaaS, an app or on-premise software, affects which obligations apply.
Acquirers and investors increasingly ask for a component list. Preparing one early, and fixing gaps, avoids delays at closing.
| Area | What is usually checked |
|---|---|
| Employees | IP assignment and confidentiality clauses in employment agreements |
| Contractors and agencies | Written assignments for code, designs and content |
| Open source | Component list, licence types and compliance with notices or source-sharing duties |
| Third-party content | Licences for fonts, stock media, music and data sets |
Ownership rules to get right
Work made by an employee in the course of employment generally belongs to the employer. Work by an independent contractor or agency generally stays with its author unless assigned in writing. An assignment should state the rights, the duration and the territory; under the Copyright Act, silence on duration means five years and silence on territory means India.
Enforcement and where disputes are heard
Preserve evidence first: URLs, screenshots with dates, app listings, copies of the infringing material and your original files and commit history. Platform takedowns resolve many disputes; others need a legal notice or a suit.
Section 62 of the Copyright Act allows a copyright owner to sue where it resides or carries on business. The Karnataka High Court does not hear ordinary civil suits at first instance, so Bengaluru suits are generally filed before the competent commercial or civil court, subject to value.

Copyright Lawyers in Bangalore (Bengaluru): frequently asked questions
Does my start-up own code written by contractors or an agency?
Not automatically. Unless there is a written assignment, the contractor or agency generally owns the copyright. Get assignments signed before funding or sale.
Can using open-source software create copyright problems?
Yes, if licence terms are not followed. Permissive licences usually require notices; copyleft licences such as the GPL can require source code to be shared when software is distributed.
Should we register copyright in our software?
Registration is optional because copyright exists automatically, but the registration entry is prima facie evidence of the recorded particulars. It can help in licensing and disputes.
A competitor's app copies our interface and artwork. What can we do?
Preserve the evidence, assess what is original in your work, then consider an app-store complaint, a legal notice or a suit.
Where is a copyright case filed in Bengaluru?
Generally before the competent commercial or civil court in Bengaluru, subject to value. Section 62 of the Copyright Act may allow filing where the owner carries on business.
